1. Introduction
Welcome to Onena Home Healthcare Michigan (βOnena,β βwe,β βour,β or βusβ). These Terms & Conditions govern the use of our services and website. By engaging our services, you agree to comply with these terms.
These terms apply to all clients, family members, caregivers, employees, and website users.
2. Scope of Services
Onena Home Healthcare Michigan provides:
- Personal care services (ADLs β Activities of Daily Living)
- Non-medical home care
- Skilled nursing services (when ordered by a physician)
- Family caregiver support and training
Services are provided in accordance with Michigan state regulations and individualized care plans.
3. Compliance with Michigan Law
Onena Home Healthcare operates in accordance with applicable laws of the State of Michigan, including:
- Licensing and operational standards (if applicable)
- Caregiver screening and employment laws
- Patient rights and safety regulations
Clients and representatives agree to comply with all applicable state and federal requirements.
4. HIPAA & Confidentiality Compliance
Onena Home Healthcare complies with the Health Insurance Portability and Accountability Act (HIPAA).
We agree to:
- Protect all Protected Health Information (PHI)
- Use client data only for treatment, payment, and operations
- Maintain administrative, technical, and physical safeguards
Clients agree:
- To provide accurate health information
- To authorize necessary communication with healthcare providers and insurers when needed

5. Client Rights
Clients have the right to:
- Be treated with dignity and respect
- Participate in care planning
- Receive clear information about services
- Refuse services (with acknowledgment of risks)
- File complaints without retaliation
6. Care Plans & Service Agreements
- Services are based on a written care plan
- Care plans may be updated as client needs change
- Clients or authorized representatives must approve services
Onena does not provide services beyond the agreed scope unless updated.
7. Payment Terms (Private Pay & Services)
Private Pay:
- Payment is due per agreed schedule (weekly, bi-weekly, etc.)
- Late payments may result in service suspension
- Additional charges may apply for:
- Overtime
- Holidays
- Short-notice scheduling
Insurance Coordination:
We may coordinate with:
- Aetna
- UnitedHealthcare
- Meridian Health Plan
Coverage is not guaranteed and remains the responsibility of the client or insurer.
8. Scheduling & Cancellation Policy
- Minimum 24-hour notice required for cancellations
- Late cancellations or missed visits may incur fees
- Emergency schedule changes may occur due to:
- Weather
- Illness
- Caregiver availability
We strive to maintain consistent care coverage.
9. Caregiver Assignment & Conduct
- Caregivers are assigned based on skill, availability, and client needs
- Substitutions may occur when necessary
- Clients must maintain a safe, respectful, and non-discriminatory environment
Onena reserves the right to remove caregivers from unsafe environments.
10. Safety & Client Responsibilities
Clients agree to:
- Provide a safe working environment
- Disclose hazards (pets, smoking, unsafe conditions)
- Follow safe care recommendations
Onena prioritizes:
- Proper lifting techniques
- Infection control
- Injury prevention
11. Background Checks & Employment Compliance
All caregivers undergo:
- Criminal background checks
- Elder abuse registry checks
- Child abuse/neglect screenings
We comply with Michigan workforce safety and screening requirements.
12. Family Caregiver Participation
Family caregivers working through Onena must:
- Meet onboarding requirements
- Complete training (if not licensed)
- Pass background checks
Training ensures safe and effective care, even for family members.
13. Limitation of Liability
To the fullest extent permitted by law:
Onena Home Healthcare Michigan is not liable for:
- Medical outcomes beyond our scope
- Client decisions that contradict care recommendations
- Delays due to emergencies or external factors
Services are supportive and not a substitute for emergency medical care.
14. Emergency Situations
In case of emergency:
- Call 911 immediately
- Notify Onena as soon as possible
Caregivers are not authorized to perform emergency medical interventions beyond their training.
15. Privacy & Data Protection
Client data is handled in accordance with:
- HIPAA requirements
- Michigan privacy laws
Information is only shared as necessary for care coordination or legal compliance.
16. Termination of Services
Services may be terminated by either party:
By Client:
- With proper notice (per agreement)
By Onena:
- Non-payment
- Unsafe environment
- Violation of terms
17. Employment Disclaimer
Submission of an application does not guarantee employment.
All applicants must:
- Meet qualifications
- Pass screenings
- Provide required documentation
18. Changes to Terms
Onena reserves the right to update these Terms & Conditions at any time. Continued use of services constitutes acceptance of updated terms.
